Status of Court Case Challenging ACA Constitutionality

The ACA Advisor on the ongoing litigation regarding the individual mandate and the ACA has been updated and sent to all Partners, incorporating information about the ruling this week by the District Court for the Northern District of Texas.

ACA-AdvisorLogo_225x46The ACA Advisor titled Status of Court Case Challenging ACA Constitutionality covers the background on the lawsuit asking the Court to strike down the Patient Protection and Affordable Care Act (ACA) entirely, on the basis that the individual mandate is unconstitutional and is not severable from the rest of the ACA. The Advisor has been updated with information about the declaratory order issued on December 14 by the Court.

The co-branded Advisor has been emailed to all Partners and can also be downloaded from AdEase as an email or Word document.

Also updated is the ACA Advisor titled DOL Issues Final Regulations Regarding Association Health Plans to incorporate information about guidance issued on December 3 by the Department of Labor on when to file and how to complete portions of Form M-1, which must be filed by all association health plans.
