New and Updated Compliance Advisors

Two updated Advisors and one new Advisor are available on AdEase to help you keep your clients informed of recent developments in employee benefits legislation.

ACA-AdvisorLogo_225x46The compliance team has created a new 2019 Compliance Calendar that outlines the federal law requirements that apply to employer-sponsored group health plans, with timing for compliance and due dates where they are applicable. Because of the length of the calendar, it is available only as a Microsoft Word document.

On March 25, the U.S. Department of Health and Human Services released another Bulletin in which it re-extended its transitional policy to permit renewals of individual and small group policies with a termination date no longer December 31, 2019, that do not meet the "market reform" requirements of the ACA, provided that they come into compliance by January 1, 20121. Our previously-published Advisor, Option for Some to Renew Policies that Do Not Fully Meet ACA Standards, has been updated to reflect this extension. Also due to its length, this Advisor is available only as a Microsoft Word document.

In June 2018, the U.S. Department of Labor (DOL) issued a final rule that broadened the definition of "employer" and the provisions under which an employer group or association may be treated as an "employer" sponsor of a single multiple-employer employee welfare benefit plan and group health plan. On March 28, 2019, the U.S. District Court for the District of Columbia found that the DOL's final rule exceeded its authority and that the final rule's provisions are unlawful and must be set aside. Our previously-published Advisor, DOL Issues Final Regulations Regarding Association Health Plans, has been updated to reflect this new development. The updated Advisor has been emailed to Partners and is available for download from AdEase as both an email and Word document.
