The October Compliance Recap has been emailed to Partners, and is available from AdEase along with several updated Advisors.

The Update to Tri-Agency Final Rules on Health Reimbursement Arrangements Advisor has been updated to add a clarification of the notice requirement for HRAs.

While there have been no recent statutory or regulatory changes to grandfathered plans, the FAQ about Grandfathered Plans Advisor has been updated to reflect current cost sharing percentages, deductibles, and plan years.

The Contraception Mandate Rolled Back for Employers Advisor has been updated to reflect a recent Ninth Circuit Court of Appeals decision regarding two final rules issued by the Treasury, Department of Labor and Department of Health and Human Services regarding contraceptive coverage exemptions.

The State Guide to Small Employer Definition, originally published in 2016, has been extensively updated with more detailed descriptions of what constitutes a small employer in each state, along with links to the relevant state regulations.

Our two Advisors providing an Update on Nondiscrimination Regulations Relating to Sex, Gender, Age, and More (one specifically for health care providers), have been revised to reflect a recent U.S. District Court order that vacated portions of Section 1557's regulations that prohibited discrimination on the basis of gender identity and pregnancy termination.

Also recently sent to all Partners was an update to HRAs, HSAs, and Health FSAs – What's the Difference? that reflects the IRS' recently published proposed rules that clarify how the ACA's employer shared responsibility provisions and Section 105(h) nondiscrimination rules apply to HRAs that are integrated with individual insurance coverage or Medicare. As a complement to that, an HRA Comparison Chart was published that incorporates the new individual coverage HRA and excepted benefit HRA with an overview of other types of HRAs.
