New and Updated Compliance Advisors

In addition to this month's Compliance Recap, sent to Partners on Friday last week, the Compliance team has updated six other Advisors based on recent regulatory updates.

Compliance_AdvisorOn May 24, the U.S. Department of Health and Human Services' Office of Civil Rights (OCR) released a proposed rule to revise its regulations under the ACA's Section 1557, which deals with nondiscrimination. Our previously-published Advisor, Update on Nondiscrimination Regulations Relating to Sex, Gender, Age, and More, has been revised to include the new information about the proposed rule. This updated Advisor was also emailed to all Partners. In addition, a version of the Advisor specifically for health care providers is available on AdEase, titled Update on Nondiscrimination Regulations Relating to Sex, Gender, Age, and More - for Health Care Providers.

Also on May 24, the OCR issued a new fact sheet that lists the ways that a business associate can have direct liability under HIPAA. Our previously-published Advisors, the HIPAA Best Practices Guide and How HIPAA Applies to Health and Welfare Benefit Brokers have been updated to include the list of HIPAA violations that can lead to direct liability for a business associate. Important note: The advisor about HIPAA and benefit brokers is for Partner use and is not intended to be sent to clients or prospects.

On June 4, the IRS released the health savings account contribution annual limit, the minimum deductible for a high deductible health plan, and the maximum out-of-pocket expense limit for an HDHP in 2020. Our previously-published Advisors, HSAs – What You Need to Know and HRAs, HSAs, and Health FSAs – What's the Difference? have been updated to reflect these new amounts and limits for 2020.
