Updated Compliance Advisors

Posted by: Meg Cipar    Dec 16, 2019

Co-branded versions of new Advisors were sent today to all Partners with a 2020 calendar of important compliance due dates and the final forms and instructions for 2019 ACA reporting. In addition, the Advisors on coverage transparency and opt-outs arrangements have been updated.

The 2020 Compliance Calendar will give your clients a quick view of important deadlines and requirements for:

  • Form W-2
  • Forms 1094-B, 1094-C, 1095-B, and 1095-C
  • Creditable Coverage Disclosure
  • Individual Coverage Health Reimbursement Arrangement Notice
  • Summary Annual Reports
  • and many more

The calendar covers only deadlines under federal law. Employers should check with their attorney on applicable state laws.

Since the Advisor we sent last week about draft 2019 ACA reporting forms, the IRS has released the final forms. A co-branded email titled IRS Releases Final 2019 ACA Reporting Forms and Instructions was sent to all Partners and includes links to the official, final forms and instructions.

In addition to these two new Advisors, the Compliance team has updated the advisor titled Proposed Rules on Coverage Transparency and Final Rules on Hospital Price Transparency. The Advisor now includes a link to a model disclosure notice on coverage transparency and links to Department of Labor tables of proposed data elements that a plan or issuer would be required to include in a Negotiated Rate File and in an Allowed Amount Table.

Also available is a revised advisor titled Are Opt-Outs on the Way Out? that was originally published in 2016. There are no new regulations or changes in the law. The Advisor is frequently requested by Partners, so has been refreshed with the new brand and information that the Compliance team frequently provides to Partners who ask about opt-out arrangements.
